France’s 2016 contract law reform has revamped the concept of lapse (caducité), in which lawyers are well-versed. This article provides a brief outline of what that entails under contract law in general and pays a closer look at what constitutes grounds for the lapse of financing agreements specifically and at how the matter is approached in practice, the Loan Market Association having failed to address the heightened risk posed by the current health crisis.
